Legal & regulatory analysis

Description

The methods of legal analysis include, in particular, the classification of new technologies and applications in the existing legal system, the further development of legal matters, and legal comparisons with other European countries.

CLASSIFICATION OF NEW TECHNOLOGIES, APPLICATIONS AND BUSINESS MODELS IN THE EXISTING LEGAL FRAMEWORK

For new areas of application, technologies and business models, there are usually no explicit provisions, which often leads to legal uncertainty. Here, it is important to examine the current state of the law and to draw any analogies in order to be able to make a classification. For this purpose, agreements under international law, requirements under EU law, as well as the Austrian legal and regulatory framework are examined and general deductions are made from them. In addition, legal support and analysis of issues that arise during the actual realization of projects is often carried out.

FURTHER DEVELOPMENT OF LEGAL MATTERS

Through the interdisciplinary cooperation in many projects, the existing legal conditions are evaluated from different perspectives (technical, economic, …) and especially from practical experience. This very often shows where the current law may pose problems for the realization of business models or technologies, but especially for the climate and energy policy goals. Based on these experiences, the Energieinstitut an der JKU Linz prepares reports, position papers, but also statements on laws, ordinances and other rules of technology (in the process of development), and develops recommendations for legal adjustments.

COMPARATIVE LAW

In addition to the analysis of the European and Austrian legal and regulatory framework, selected implementation acts of other European member states are examined comparatively. In addition to literature research, the legal framework is surveyed by means of questionnaires and interviews, and a legal comparison is made with the Austrian legal situation. Depending on the project, not only a European but also an international cooperation results, which makes it possible to examine and comparatively present the project-related legal and regulatory framework conditions. Finally, derivations for the further development of the Austrian legal framework are made from this.
